GENERAL TERMS AND CONDITIONS OF SALE FOR TEACHING AND SUPERVISION SERVICES FOR OUTDOOR SPORTS ACTIVITIES

1. Preliminary Provisions
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply in full as of 1 June 2022 to all teaching and supervision services for outdoor sports and leisure activities (hereinafter referred to as “Services” or “Outdoor Activities”), as well as related services offered by the Evolution 2 Ski and Adventure School.
Outdoor Activities and related services are described on the Website.
The GTC govern any booking of Services made by telephone, at the School’s office, or online via the School’s website (the “Website”).
Booking any of the aforementioned Services implies full and unconditional acceptance of these GTC, notwithstanding any contrary stipulation.
2. Seller Identification
The Services covered herein are organised on behalf of independent professional instructors and educators affiliated with the Evolution 2 Ski and Adventure School (the “School”) and sold by:

3. Services – Outdoor Activities
Services and Outdoor Activities are provided in the form of group or individual courses/workshops by professionals authorised to teach skiing and related disciplines.
The main Outdoor Activities offered by the School, without limitation, include:
- Ski and other snow sports courses/workshops (snowboard, telemark, ski touring, freeride, freestyle);
- Supervision and rental of mountain bikes/e-bikes, snowmobiles, buggies, snowshoeing, rafting, canyoning, adventure courses, quad biking, buggy, 4x4.
The proper conduct of courses/workshops requires participants to have a similar skill level. Each participant is responsible for selecting the appropriate technical level according to the scale established by the School.
4. Participation Conditions / Safety
4.1 Supervision
The School reserves the right to adjust groups and move any participant whose level does not match their stated ability, subject to availability in other groups. The professional will inform the participant and/or the responsible person for minors. Group courses/workshops are confirmed subject to a minimum number of participants (4 people). Otherwise, the group course will be converted into shared private lessons with a reduced duration depending on the number of participants.
4.2 Equipment and Helmet Use
Participation in courses/workshops and all Outdoor Activities requires appropriate technical equipment in good condition and suitable clothing for each activity.
Each participant must check the necessary equipment for the chosen Outdoor Activity on the Seller’s Website. The School reserves the right to refuse any participant lacking the required equipment.
Snow sports activities involve risks; wearing a helmet is mandatory for children under 13 and strongly recommended for all. Helmets are compulsory for snowboard, off-piste courses, regardless of age.
4.3 Safety / Timings
Participants must not be under the influence of alcohol or any psychotropic substances. They must follow the professional’s advice before and during the Service. The presence of a professional does not eliminate inherent risks. The School reserves the right to exclude any person whose behaviour disrupts the course/workshop or compromises safety.
Outdoor Activities take place in environments with unpredictable conditions. Each participant must ensure their own safety and that of others. Participants must arrive at the location, date, and time indicated in the booking.
In case of delay for a private lesson, the professional will provide the Service until the originally scheduled end time without extension. For group workshops, the professional will not wait for late participants.
4.4 Ski Courses
Ski equipment is not included in the booking, nor are lift passes unless otherwise stated by the Seller. When required, participants must arrive with a valid lift pass. Without it, the professional may refuse the course without refund.
5. Activity Booking
Bookings for Outdoor Activities or related services (hereinafter “Booking”) can be made:

Each booking must include selected Services, date or period, number and age of participants.
Pre-contractual Information
Before confirming the booking, participants acknowledge receiving clear and understandable pre-contractual information as per Article L.221-5 of the French Consumer Code, including:
- Description and essential characteristics of the Service;
- Price and execution date;
- Existence and conditions of the right of withdrawal.
Booking by Phone
Participants must provide their email address and name. After receiving pre-contractual information, they confirm acceptance and proceed with payment as per Article 7.
Online Booking
Participants must provide their email and complete a form. They can review and correct details before confirming. To finalise, they must accept the GTC and proceed with payment as per Article 7.1.
Booking Confirmation
The booking becomes firm and final once full payment is received. The sales contract is then deemed concluded. For remote bookings, participants receive an email confirmation summarising purchases, price, and essential characteristics.
6. Price
The applicable rates indicated on the Seller’s communication materials and Website are stated in euros, inclusive of all taxes (VAT included). In general, unless otherwise specified, the price of Services does not include administrative fees, equipment rental, or insurance.
The prices shown include the teaching service provided by an Evolution 2 professional, excluding any other service.
7. Payment Terms and Methods
For any Booking, the full price must be paid in one installment. Payment is confirmed by email. Payment may be made by credit card, cash, or ANCV holiday vouchers (up to 50% of the total amount). Electronic payments made remotely or online via the Seller’s Website are secured using encryption technology to ensure confidentiality and data security.
Credit Card
For any Booking made remotely or at the School’s office, payment can be made by credit card. Unless otherwise indicated at the time of Booking, only CARTE BLEUE/VISA and EUROCARD/MASTERCARD cards are accepted. For Bookings at the School’s office, a payment receipt is issued immediately after payment. For remote Bookings, the receipt is sent by email.
Cash
For Bookings made at the School’s office, payment can be made in cash. Cash payments are limited to €1,000 per Booking, in accordance with Articles L112-6 and D112-3 of the French Monetary and Financial Code.
ANCV Holiday Vouchers
To pay by ANCV holiday vouchers, the participant must send the vouchers to the Seller within 72 business hours after making the Booking. The Booking becomes final only after the Seller receives payment. Vouchers must be valid at the time of purchase. No refunds can be issued for ANCV vouchers.
8. Liability – Insurance
The School is responsible for the proper execution of the Services booked by each participant. However, given the active role of the participant during sports activities, the responsibility of the Evolution 2 professional is limited to an obligation of means. Each participant must comply with the instructions given by the School’s professional.
Participants are solely responsible for their equipment.
It is recommended that participants take out insurance covering risks inherent to mountain sports activities (civil liability, personal accident, rescue).
9. No Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to remote purchases of services relating to accommodation, transport, catering, or leisure activities, ordered as a package or separately, for a specific date or period. Consequently, any Booking offered by the Seller is not subject to a withdrawal period.
10. Cancellation
By the Seller
The School reserves the right to cancel or interrupt Outdoor Activities in the following cases:
- Due to force majeure as defined in Article 11 or any other unforeseeable event;
- If the minimum number of participants is not reached.
The School will inform the participant as soon as possible and will endeavor to offer an equivalent substitute. If the participant does not accept the proposed substitute, they may request cancellation of their Service and reimbursement of amounts already paid, prorated for unused sessions in the event of interruption.
Beyond this reimbursement, no compensation of any kind will be granted.
By the Participant
Cancellation fees apply as follows:
- Cancellation 7 days or less before the scheduled date: No refund. The full amount remains due.
- Cancellation between 30 and 8 days before the scheduled date: 10% of the total amount will be retained as administrative fees, with a minimum of €20. The remaining balance will be refunded within a reasonable time.
- Cancellation more than 30 days before the scheduled date: Full refund without fees.
The Client acknowledges having read and accepted these cancellation conditions before confirming their booking.
11. Force Majeure
If the execution of Services booked by the participant is delayed or prevented, in whole or in part, due to a force majeure event as defined by Article 1218 of the French Civil Code, the participant will be informed by any means. In case of force majeure (e.g., weather conditions making courses unsafe, piste closures, lack of snow), the School’s obligations are automatically suspended without liability. However, the School may offer the participant an alternative date for the affected Services.
12. Proof, Storage, and Archiving
In accordance with Article L213-1 of the French Consumer Code, for any online Booking on the Seller’s Website of €120 or more, the Seller ensures the preservation of the written record of the Booking for ten years from delivery and guarantees access to it during this period.
13. Termination Clause
Except in cases of force majeure, if the School fails to provide the Services on the agreed date or within the agreed timeframe, the participant may terminate the contract by registered letter with acknowledgment of receipt or by written notice on another durable medium, after granting the School a reasonable additional period to perform.
The participant may also terminate the contract immediately if the School refuses to provide the Services or fails to do so on the agreed date or within the agreed timeframe, and this date or timeframe constitutes an essential condition of the contract (Article L216-6 of the French Consumer Code).
14. Intellectual Property Rights
The Seller’s Website is subject to French copyright and intellectual property law. Any total or partial reproduction of trademarks, logos, or distinctive signs from the Website without the Seller’s express written authorization is prohibited under Article L713-2 of the French Intellectual Property Code.
15. Personal Data
Personal data collected during a Booking is processed for the following purposes:
- Managing the Booking (necessary for contract execution);
- Providing access to the Service/Outdoor Activity (necessary for contract execution);
- Sending commercial offers, newsletters, invitations to games, contests, or satisfaction surveys (based on the Seller’s legitimate interest or participant consent for partner messages).
Unless otherwise stated, all fields are required for processing.
Data is retained as follows:
- Booking management:
- Electronic bookings: 5 years if under €120; 10 years if €120 or more;
- Non-electronic bookings: 5 years.
- Bank card data: retained for 15 months for dispute purposes (cryptogram not retained).
- Marketing data: retained for 3 years, renewed upon significant interaction.
Participants have rights of access, rectification, erasure, portability, restriction, and objection. Requests can be made to:

Participants may also file a complaint with CNIL (www.cnil.fr).
To opt out of telephone marketing, participants can register at www.bloctel.gouv.fr or write to: Société Opposetel, Service Bloctel, 6 rue Nicolas Siret, 10000 Troyes.
16. Complaints and Dispute Resolution
These GTC are governed by French law. Any complaint regarding the booking or execution of Services must be sent to the Seller’s Complaints Department by registered letter with acknowledgment of receipt within 20 days of Service execution, with supporting documents (booking proof, medical certificate, photos, report).
If no satisfactory response is received within 60 days, the participant may use free mediation through the Tourism and Travel Mediator (www.mtv.travel) within one year of the written complaint.
Failing amicable resolution, disputes may be brought before the court of the defendant’s domicile.
