1. PRELIMINARY PROVISIONS
These general terms and conditions of sale (hereinafter the “Terms and Conditions” or “GTC”) shall apply in full from June 1, 2022, to all teaching and supervision services for sports and outdoor leisure activities (hereinafter the “Services” or “Outdoor Activities”), as well as related services, offered by the Evolution 2 Ski and Adventure School.
The Outdoor Activities and related services are described on the Website.
The GTC govern any booking of Services made by telephone, at the School’s office, or online via the School’s website (Evolution 2 Val Cenis or Evolution 2 Valfréjus).
Booking any of the aforementioned Services implies full and unconditional acceptance of the GTC, notwithstanding any contrary stipulation.
2. SELLER IDENTIFICATION
The Services covered herein are organised on behalf of independent instructors and professional educators who are members of the Evolution 2 Ski and Adventure School (the “School”), and are sold by:

3. SERVICES – OUTDOOR ACTIVITIES
The Services and Outdoor Activities are delivered as group or individual lessons/courses by professionals authorised to teach skiing and related disciplines.
The main Outdoor Activities offered by the School include, without limitation:
- Ski lessons and courses, as well as other snow sports (snowboard, ski touring, freeride, freestyle);
- Activities supervised by the School or its service providers: Mountain’kart, Yooner, snowmobile, moonbike, snowshoeing, hydrospeed, packraft, canyoning, zipline, via ferrata, dog sledding.
Proper organisation of courses requires homogeneous levels among participants. Each participant is responsible for choosing their technical level in accordance with the grid established by the School.
4. CONDITIONS OF PARTICIPATION / SAFETY
4.1 Supervision
The Evolution 2 School reserves the right to adjust groups and reassign a participant whose level does not match their declared level, subject to availability in other groups. The professional instructor shall inform the participant and/or the legal guardians of any minor participant.
Group lessons/courses are confirmed subject to a minimum number of participants (4 people). Otherwise, the group lesson will be converted into shared private lessons, with a reduced duration depending on the number of participants.
4.2 Equipment and Helmet Requirements
Participation in any Outdoor Activity or ski course requires appropriate and well-maintained technical equipment, as well as suitable clothing for the chosen activity.
Each participant must check the required equipment on the Seller’s Website. The School reserves the right to refuse any participant who does not have the necessary equipment.
Given the risks of snow sports, wearing a helmet is mandatory for children under 13 and strongly recommended for all. Helmets are mandatory for snowboard and off-piste courses, regardless of age.
4.3 Safety / Schedule
Participants must not be under the influence of alcohol or any psychotropic substance. Each participant must pay attention to the professional’s instructions before and during the Service.
Instructor supervision does not eliminate all risks inherent to the activity. The School reserves the right to exclude any participant whose behaviour endangers the course.
Outdoor Activities take place in environments with unpredictable conditions. Participants must personally ensure their own safety and that of others. They must arrive at the location, date, and time indicated in the booking.
In case of lateness for a private lesson, the instructor will provide the Service until the originally scheduled end time and cannot extend it. For group courses, the instructor will not wait for late participants.
4.4 Ski Lessons
Ski equipment is not included in the booking of lessons/courses. The same applies to lift passes unless otherwise indicated by the Seller.
Where required, participants must attend lessons with a valid lift pass. Without one, the instructor may refuse participation without any refund.
5. ACTIVITY BOOKING
Bookings for Outdoor Activities or related services (the “Booking”) may be made:

All bookings must specify the selected Services, date or period, number and age of participants.
1. Pre-contractual Information
The participant acknowledges having received all pre-contractual information listed in Article L.221-5 of the French Consumer Code, including:
- Description and essential characteristics of the Service
- Price and execution date
- Existence and conditions of the right of withdrawal
2. Booking by Phone
The participant must provide the mandatory information, including email address and participant name. After receiving the mandatory information, the Seller invites the participant to review the GTC. Once agreed, payment is made remotely per Article 7.
3. Online Booking
The participant must provide their email address and complete a form. Under Article 1127-2 of the French Civil Code, they may review and correct any errors before confirming the Booking. They must accept the GTC and proceed with payment (Article 7.1).
4. Booking Confirmation
The Booking becomes final once full payment has been received. The sales contract is then considered concluded.
Participants will receive a confirmation email summarising the Booking.
6. PRICES
Prices shown on communication materials and the Website are in euros, VAT included. Unless otherwise specified, prices exclude administrative fees, equipment rental, and insurance.
Prices include the teaching service delivered by an Evolution 2 professional, and exclude any other service.
7. PAYMENT TERMS AND METHODS
Full payment is required at the time of Booking. A confirmation email will be issued. Payment methods include: bank card, cash, and ANCV holiday vouchers.
5. Bank Card
Accepted cards: CARTE BLEUE / VISA and MASTERCARD. A payment receipt is provided immediately in person or by email for remote bookings.
6. Cash
Cash payments at the School office are limited to €1,000 per booking (Articles L112-6 and D112-3 of the Monetary and Financial Code).
7. ANCV Vouchers
Paper ANCV vouchers must be sent within 72 business hours after Booking. Booking becomes final only after receipt. No refunds are possible for ANCV vouchers.
ANCV Connect is available by contacting the Seller directly.
8. LIABILITY – INSURANCE
The School is responsible for the proper execution of Services. However, due to the participant’s active role during sports activities, the instructor’s obligation is one of means, not result.
Participants are responsible for their own equipment.
They are advised to purchase insurance covering mountain sports risks (civil liability, accident, rescue costs).
9. NO RIGHT OF WITHDRAWAL
Under Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to leisure services scheduled for a specific date. Therefore, no withdrawal right applies to Bookings.
10. CANCELLATION
8. By the Seller
The School may cancel or interrupt Activities in the following cases:
- Force majeure (see Article 11) or other unforeseen events
- Insufficient number of participants (minimum 4)
The School will inform the participant promptly and may propose an equivalent alternative. If refused, the participant may request cancellation and refund, prorated if the activity was interrupted.
No other compensation is due.
9. By the Participant
Cancellation fees:
1. Within 7 days or less before the activity:
No refund. Full amount due.
2. Between 30 and 8 days before the activity:
A 10% fee applies, minimum €20. Remainder refunded within a reasonable timeframe.
3. More than 30 days before the activity:
Full refund, no fees.
The Client acknowledges having read and accepted these terms before confirming their booking.
11. FORCE MAJEURE
In case of force majeure (as per Article 1218 of the Civil Code) delaying or preventing execution of Services, the participant will be informed. Obligations are suspended. The School may propose a rescheduled date.
12. PROOF AND ARCHIVING
Under Article L213-1 of the Consumer Code, the Seller archives contracts of €120 or more for 10 years and grants access to the participant during that period.
13. TERMINATION CLAUSE
Except in cases of force majeure, if the School fails to deliver the Services within the agreed timeframe, the participant may terminate the contract after issuing a formal demand with a reasonable extension period. Termination may be immediate if timely execution was an essential condition (Article L216-6 of the Consumer Code).
14. INTELLECTUAL PROPERTY
The Seller’s Website is protected under French copyright law. Any reproduction of trademarks or logos without written consent is prohibited (Article L713-2 of the Intellectual Property Code).
15. PERSONAL DATA
The personal data collected during Booking are processed for:
- Managing the Booking (necessary for contract performance)
- Providing access to the Service (necessary for contract performance)
- Sending promotional offers, newsletters, invitations (based on legitimate interest or participant consent)
The data controller is the Seller.
Data recipients: the Seller, partners (if consent is given), and service providers.
Data retention periods include:
- Booking data:
- 5 years (Bookin < €120)
- 10 years (Booking ≥ €120)
- Bank card data: 15 months (excluding CVV)
- Marketing data: 3 years after collection, renewable upon new interactions
Security measures include firewalls, access controls, and physical safeguards.
Participants have rights to access, rectify, erase, limit, transfer, or object to processing. They may withdraw consent at any time.

Participants may register on Bloctel to oppose telephone solicitation.
16. CLAIMS AND DISPUTE RESOLUTION
The GTC are governed by French law. Claims must be sent by registered mail within 20 days of the Service, with supporting documents.
If unresolved after 60 days, the participant may contact the Tourism and Travel Mediator (www.mtv.travel) within one year.
Failing amicable settlement, disputes may be brought before the competent court.
